Welcome to SM Photobooth Rentals. By using our photobooth website and services ( Photo booth Rentals) , you agree to these Terms and Conditions ("Terms"). Please read them carefully.
1. Use of Our Services
You agree to use our Services for lawful purposes only. You will not misuse our Services or use them for any unlawful or prohibited purpose.
2. Booking and Payments
Booking Confirmation: A booking is confirmed only after we receive a signed agreement and a non-refundable deposit of 50% of the total Package.
Final Payment: The balance of the booking fee must be paid 14 days before the event date.
Payment Methods: We accept payment by Google pay. Credit/ Debit.
3. Cancellation and Refunds
Cancellation by You: Cancellations made 30 days prior to the event are eligible for a full refund of any payments made, excluding the deposit. Cancellations made after this period are non-refundable.
Cancellation by Us: We reserve the right to cancel the booking in cases of force majeure, illness, or equipment failure. In such cases, we will refund all payments made.
4. Service Delivery
Setup and Breakdown: We require access to the venue one and a half hours before and after the event for setup and breakdown.
Space Requirements: You must provide adequate space, power, and internet access if required for the photobooth.
Supervision: Our staff will supervise the photobooth operation unless otherwise arranged.
5. Photos and Privacy
Photo Usage: By using our Services, you grant us the right to use photos taken during the event for marketing purposes (e.g., website, social media), unless you opt out in writing.
Privacy: We comply with Canadian privacy laws (e.g., PIPEDA). Personal information collected will be used only for booking, communication, and providing our Services.
Opt-Out: If you do not wish for your photos to be used, please notify us in writing at she@smphotoboothrentals.com.
6. Limitation of Liability
We are not liable for any indirect, incidental, or consequential damages resulting from the use of our Services. Our liability for any claim shall not exceed the amount paid for the Services.
7. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or liabilities arising from your use of the Services or any breach of these Terms.
8. Governing Law
These Terms shall be governed by and construed under the laws of the Province of Ontario and the federal laws of Canada.
9. Amendments
We reserve the right to update these Terms at any time. Any changes will be posted on our website and become effective immediately upon posting.
